Nottingham woman in NHS claim

Mrs Misiwicz of Nottingham, was provided with the choice to have an operation at a private hospital, this choice was offered by the NHS. Although now, the lady is claiming for compensation due to a swab, the approximate size of a tea towel was left inside her after the operation had ended. The hysterectomy was carried out at the private Nottingham Woodthorpe Hospital and was funded by the NHS. It appears that the swab was left inside the woman after a second operation which was carried out in order to stop internal bleeding. The hospital has stated that the claim is now in the hands of their solicitors and that they would work with them in order to resolve this situation. The woman began to worry that something was wrong when she felt ill for weeks after the operation, at this point she was unaware of the swab being left in her. She stated, I was in continual pain, absolutely shattered. It was a nightmare and I just didnt want to get out of bed in a morning. The lady states she decided to take the NHS up on the offer of using a private hospital as she wanted the operation over as quickly as possible. The swab was spotted by a clinic operated by Ramsey Health; it was removed in November 2009. The ladies solicitors are now working in order to discover which party is liable, either the NHS or the private hospital. This will depend on the contract which was agreed between the two parties in regards to the operation and also after care for Mrs Misiwicz. At present, neither party is prepared to take responsibility for this incident occurring.
